Independent Democrats celebrates yet another court victory, the 6th court victory in just five days

31-08-2007, 17H10, A Cape High Court judge has upheld the ID’s expulsion of another three public representatives from the party.

President De Lille says ‘ID dissidents have wasted the time of the courts.

‘These dissidents were in politics not to serve the people of South Africa, but for their own personal gain and greed, says De Lille.

‘The ID reassures the South African public that we will not hesitate to act against any public representative, whether in our party or another party, who has betrayed the trust of the voters.’

In the latest case, JJ Januarie, Rudolph Smit and Jakes Botha became ex-ID members.

‘The judgements of the courts have shown that we have acted in a fair and just manner. Each one of them was afforded an opportunity to be heard internally, but declined and ran straight to court before they exhausted the internal processes of the Independent Democrats,’ De Lille says.

‘The court made it very clear that they are not there to act as a substitute for a political party’s internal processes.

‘I have always put my faith in the independence of our judiciary, who have shown that they will act to uphold the Constitution,’ says De Lille.

President De Lille says that ‘the Social Democratic Party is a stillborn party.’

These are the five court victories of the Independent Democrats:

1.     Harding lost two court cases against the ID in just one week. Judge Dennis Davis ruled in the Cape High Court on Wednesday that Harding appear before a disciplinary hearing for sexual harassment today, while today Judge Davis ruled in favour of the ID’s expulsion of Harding, with costs.

De Lille says – ‘Harding’s claim that he was a professional politician and his livelihood would be affected negatively by this was treated by the Judge with the contempt it deserves. The Judge reminded Harding that his livelihood depends on the electorate.’

2.     On Monday this week two court judgements ruled in favour of the Independent Democrats against David Sasman. The latter now faces legal bills for himself and the ID of close to a quarter of a million rand. Sasman claimed to suffer from a designer illness, Agoraphobia, for one year.

3.     Achmat Williams tried to interdict the ID yesterday to stop an internal appeal hearing today, but he also lost, also with costs.

4.     Application of Rudolph Smit, JJ Januarie and Jakes Botha dismissed with costs.

The Independent Democrats will return to the Cape High Court this afternoon at 14H15 to seek judgement against JJ Januarie, Rudolph Smit and Jakes Botha, to face the same charges as Harding.
